Update on the Glenmark Symed dispute

(There is a correction to this post. One of our commentators has brought to our attention the Division Bench order available here, and that there was no remand to the Single Judge. The appeal has been admitted, the order of the Single Judge has been stayed and the matter is listed for arguments on April 6)

SpicyIP had earlier reported on the injunction order awarded by the Delhi High Court against Glenmark’s manufacture of Symed’s linezolid. We now have more updates on this for our readers, thanks to our ever-enthusiastic commentators.

Glenmark filed an appeal against this injunction order which was heard by a Division Bench of the Delhi High Court consisting of Justice Bader Durrez Ahmed and Justice Sanjeev Sachdeva day before yesterday. Glenmark was represented by Mr. Chidambaram while Symed was represented by Mr. Gopal Jain.  Arguments on this matter was heard over 45 minutes, at the end of which the Division Bench vacated the order vide a detailed order and remanded the matter to the Learned Single Judge.
