The Academy of Intellectual Property Studies, Mumbai announces a One Day Seminar on “PRECEDENTIAL PATENT CASES” on September 23. 2010, at their premises in Goregaon. The Seminar will be conducted by Feroz Ali Khader, the Chennai-based IP lawyer, and author of several books on patent law in India. It will likely be a fascinating seminar to attend. The decisions of the Intellectual Property Appellate Board, the High Courts and the Supreme Court have precedential effect on the Patent Offices, and there have been many instances of Controllers citing decisions of the IPAB and the High Court as binding precedents. The decisions of the IPAB and the High Court in the Novartis-Gleevec cases are still being cited and followed in a number of cases by the Patent Office. These decisions contribute to the growth and understanding of patent law. The IPAB, apart from its appellate jurisdiction where it decides appeals from Controllers, also has original jurisdiction with regard to revocation and rectification procedures. The District Courts and High Courts are the only fora where suits for infringement, declaration of non-infringement and groundless threats can be filed. Since 2005, the IPAB and the higher courts in India have rendered significant decisions affecting the development of patent law in India.

The Seminar Agenda will include:

  • Brief survey on contentious proceedings that can arise before the IPAB, District Courts, High Courts and Supreme Court.
  • Survey of all the important cases decided by the IPAB, High Courts and Supreme Courts since the Patents (Amendment) Act, 2005.
  • Analysing general trends on how the Courts decide in particular situations involving
  1. Interim injunction
  2. Writ petition over order of Controllers
  3. Stay of the operation of order of Patent Office
  4. Patent Linkage
  5. Trial in patent suits
  • Critical analysis of the powers of the IPAB vis-a-vis the power of the High Court in revocation proceedings.

Mr. Feroz Ali Khader – Advocate, Chennai High Court.
An LLM from National Law School, Bangalore plus another LLM from Trinity College, Cambridge, Mr. Feroz Ali’s specialty is in contentious patent proceedings. He is the Author of “The Law of Patents – With a Special Focus on Pharmaceuticals in India”, and has recently released his second publication “The Touchstone Effect – the Impact of Pre-grant Opposition on Patents”.
