The Ranga-Rangabati Copyright Row

The remixed version of the popular Sambalpuri song Rangabati which was aired on an episode of the MTV Coke Studio, whilst having become a massive hit on Youtube, has stirred up quite a controversy. The song infuses the original Rangabati with English-Tamil rap and the Orissa state anthem, Bande Utkal Janani. The original song’s lyricist Mitrabhanu Gauntia and music director Prabhudutta Pradhan – the disputed copyright holders of the song – have slapped Hindustan Coca-cola Beverage Private Limited, Hindustan Coca Cola Holdings…

SpicyIP Weekly Review (29 June – 5 July)

Folks, we’ve had a rather busy week ! Posts have come pouring in, covering a whole melange of issues. SpicyIP Weekly Review (15 June – 21 June )

The highlight of the week was Swaraj’s extremely fascinating post on the US and Switzerland’s efforts to bring back to life a provision that would allow complaints to be brought before the WTO Dispute Settlement System even when TRIPS provisions were not violated. India’s very much TRIPS compliant pharmaceutical patents provisions – Section 3(d) particularly – have escaped what could potentially be an explosively controversial discussion at the WTO, despite the mounting pressure from the US. Swaraj writes that even if the…

SpicyIP Trivia: When Nani Palkhivala was accused of plagiarism

Our attention was recently brought to CA Vellalapatti Swaminathan Iyer’s rather fascinating article published on the ITAT (The Income Tax Appellate Tribunal Bar Association) website here, which is based on the Palkhivala plagiarism matter written about in Nani Palkhivala: Courtroom Genius (co-authored by Soli Sorabjee and Arvind Datar). The book itself, dedicated to revealing the daunting legend that Palkhivala was, contains within it never seen before plaint, written statement as well as judgement of the Madras High Court in the Sampath…
