Goa Circular, Permission for Music at Weddings, Police Sensitization: Anything New? Yes.

Bonjour. I got you something from Goa – a circular! Yes, a circular saying that there is no need to take copyright permission for the performance of musical works at religious ceremonies/weddings/social festivals! Unsurprisingly, the same has been challenged as well, by Phonographic Performance Limited and Sonotek Cassettes Company. This brief post discusses the key elements of the current circular and underscores the previous discussion on the issue.  Goan Circular’s Sensitization of Police … While I couldn’t find the official […]

Journey Through “Januarys” on SpicyIP (2005 – Present)

Welcome back to the “Sifting Through SpicyIP Pages” series! This time, I have journeyed through the pages “Januarys” on SpicyIP since 2005 and got you some stories that, I think, have kept us occupied over the years. It’s the 8th post of this monthly series. We have already traversed through Junes, Julys, Augusts, Septembers, Octobers, Novembers, Decembers, and shared some stories like Rahul Cherian’s Legacy, 2010’s International Efforts on Pandemics, Corruption in IP Offices, Law Making via Leaked Documents, etc.

Food, Fights, and the Butter Chicken: Some More Thoughts on “The Mystery of the Real Master Chef”

Yesterday, Aparajita penned a post “Squawking over butter chicken: The mystery of the real master chef” sharing her thoughts on the existing “Who Invented Butter Chicken and Dal Makhani” issue before the Delhi High Court in Rupa Gujral & Ors vs Daryaganj Hospitality Private Limited. While she has raised several interesting points, there are a few more issues, especially concerning passing off, that I believe need highlighting. This post attempts to make sense of the media frenzy surrounding the issue,

Journey Through “Decembers” on SpicyIP (2005 – Present)

2023 has become yesteryear. 2024 has arrived. (Hope you all had a wonderful year beginning!). January is bidding adios now. In short, I am late in my sifting of SpicyIP pages. (Sorry!) But as they say, … ‘tis better late than never. So, here’s the “Decembers” post for the “Sifting Through SpicyIP Pages” series. We have traversed through Junes, Julys, Augusts, Septembers, Octobers, and Novembers and shared some stories like 10 years of the Google Books Library Project, the Presumption

IP Scholarship, Citations, and Knowledge Governance: Some Insights from the History of IP Teaching in India

Source – From Flickr’s Kevin Lim “Are Some Scholars More Equal than Others?,” a question that Prof. Basheer raised in his 2018 post on the Politics of Patent Citation. While the question made sense ever since I read the post, it started making more sense (and bothering me more) after working on the SpicyIP Open IP Syllabus where I witnessed a relative “over-accessibility” of US-European IPR scholarship. Gladly, I “could” witness it because Swaraj instructed us to be conscious of

Journey Through “Novembers” on SpicyIP (2005 – Present)

Image from here November has passed. We stand on the cusp of bidding farewell to 2023 with just 10 days remaining! So, before 2023 turns into yesteryear, let’s see what the past Novembers on SpicyIP (2005 to present) have offered. As you may know, this is part of our monthly series “Sifting Through SpicyIP Pages.” So, we have already ventured through Junes, Julys, Augusts, Septembers, and Octobers and shared some stories like P.H. Kurian’s trail of transparency, Statements of Patent

Jab “We” Met: When Intellectual Property (IP) Met Public Interest (PI), a Poem

Image from here *The word “jab” translates to “when” in English. I recently read a beautiful poem called “The Delicate Balance” authored by Professor Raman Mittal and published at SpicyIP in 2013. It is IP history in a nutshell (and perhaps much more than that), I can say. Of course, I have read and enjoyed Prof. Basheer’s poetic posts earlier (e.g., The Wow of the Now). This time I thought of sharing my pursuits on similar lines. Though mine may

Journey Through “Octobers” on SpicyIP (2005 – Present)

Image from here As October passed, Halloween festivities and the Day of the Dead provided a backdrop for contemplating the past. After all, reflecting on what’s passed helps us anticipate what’s ahead. This brings me to my Octobers’ sift – a sift that yielded some sinuous IP stories. Those who haven’t checked our Sifting Through SpicyIP Pages series yet, can check SpicyIP Flashbacks and see what we found thus far while journeying through the months of Junes, Julys, Augusts, and

Journey Through “Septembers” on SpicyIP (2005 – Present)

Image from here. Continuing our Sifting Through SpicyIP Pages series, this post dives into September’s pages and sheds light on some stories, their evolution, or sometimes, their stagnation. In the past, much like intrepid time travelers, we journeyed through the months of June, July, and August, uncovering how some stories like the Mashelkar Report, the National Biotechnology Regulatory Authority (NBRA) Bill, the Whistleblower Act, or the Indian “Bayh Dole” Bill, unfolded with time. Without further ado, here’s what I found

SpicyIP Tidbit: Acquiesce, Copyright Infringement, and Pending Suits in Trial Courts: Highlighting SC’s Recent Remarks

Image source – here The Supreme Court in Brihan Karan Sugar Syndicate Private Limited vs Yashwantrao Mohite Krushna Sahakari Sakhar Karkhana dealing with issues of passing off, acquiescence, underscored the pendency of suits in the Trial Courts in the State of Maharashtra and urged the Bar members’ cooperation with the Trial Courts. The case contains a few notable points that I found worth tidbit-ing. Let’s unfurl the facts: The case involves an appeal challenging an order of the High Court
