ATRIP Winning Essay 2023: Whither Global South’s Copyright Scholars: Lost in the “Citation Game”?

Image from here *A slightly long post discussing the key ideas of the essay.* A few months ago, I wrote a detailed post discussing the history of IP teaching in India highlighting that the same gained traction after the 2000s. There I asked, “[w]hether this delay has potentially trapped us in an epistemological framework given a canonical body of work that has already developed during or before our entry into IP teaching and research.” Peter Drahos’ words also resonate here […]

Goa Circular, Permission for Music at Weddings, Police Sensitization: Anything New? Yes.

Bonjour. I got you something from Goa – a circular! Yes, a circular saying that there is no need to take copyright permission for the performance of musical works at religious ceremonies/weddings/social festivals! Unsurprisingly, the same has been challenged as well, by Phonographic Performance Limited and Sonotek Cassettes Company. This brief post discusses the key elements of the current circular and underscores the previous discussion on the issue.  Goan Circular’s Sensitization of Police … While I couldn’t find the official

Food, Fights, and the Butter Chicken: Some More Thoughts on “The Mystery of the Real Master Chef”

Yesterday, Aparajita penned a post “Squawking over butter chicken: The mystery of the real master chef” sharing her thoughts on the existing “Who Invented Butter Chicken and Dal Makhani” issue before the Delhi High Court in Rupa Gujral & Ors vs Daryaganj Hospitality Private Limited. While she has raised several interesting points, there are a few more issues, especially concerning passing off, that I believe need highlighting. This post attempts to make sense of the media frenzy surrounding the issue,

IP Scholarship, Citations, and Knowledge Governance: Some Insights from the History of IP Teaching in India

Source – From Flickr’s Kevin Lim “Are Some Scholars More Equal than Others?,” a question that Prof. Basheer raised in his 2018 post on the Politics of Patent Citation. While the question made sense ever since I read the post, it started making more sense (and bothering me more) after working on the SpicyIP Open IP Syllabus where I witnessed a relative “over-accessibility” of US-European IPR scholarship. Gladly, I “could” witness it because Swaraj instructed us to be conscious of

Jab “We” Met: When Intellectual Property (IP) Met Public Interest (PI), a Poem

Image from here *The word “jab” translates to “when” in English. I recently read a beautiful poem called “The Delicate Balance” authored by Professor Raman Mittal and published at SpicyIP in 2013. It is IP history in a nutshell (and perhaps much more than that), I can say. Of course, I have read and enjoyed Prof. Basheer’s poetic posts earlier (e.g., The Wow of the Now). This time I thought of sharing my pursuits on similar lines. Though mine may

Journey Through “Octobers” on SpicyIP (2005 – Present)

Image from here As October passed, Halloween festivities and the Day of the Dead provided a backdrop for contemplating the past. After all, reflecting on what’s passed helps us anticipate what’s ahead. This brings me to my Octobers’ sift – a sift that yielded some sinuous IP stories. Those who haven’t checked our Sifting Through SpicyIP Pages series yet, can check SpicyIP Flashbacks and see what we found thus far while journeying through the months of Junes, Julys, Augusts, and
