India getting mixed signals from Big Pharma

The International Business Times reports that there is talk about India possibly seeing a complaint being lodged against it at the WTO due to its ‘disregard of corporate intellectual property’. This discussion came up at the US Chamber of Commerce’s event “Innovation in India: A Risky Investment?”.  According to IP-Watch, the Chamber did not do most of the talking but rather presentations were made by two think tank consultants, Shankar Singham of Babson Global and Paul Howard of Manhattan Institute. Wikileaked! Leaked IP Chapter of TPP shows that US could be an IP Terrorist

On 13th November, Wikileaks released a leaked copy of the consolidated IP negotiating chapter for the Trans-Pacific Partnership Agreement (TPP). [A big thanks to whoever leaked it to Wikileaks!]. This post will look into the contents of that leaked chapter and describe exactly how messed up it is – but first a tangential observation. In a couple of earlier posts (here and here) we had discussed certain (earlier) leaked provisions of the draft chapter US had put forth in the negotiations.

Creative Commons India relaunched

Creative Commons (CC) saw its India chapter relaunched in Delhi on November 12th by Wikimedia India, Centre for Internet & Society, and Acharya Narendra Dev College (of DU). Creative commons, as many of our readers may know, turns traditional notions of copyright on its head. Instead of the usual focus on ‘all rights reserved’, a CC license focuses on which rights the creator is relinquishing and places the focus on “some rights reserved” allowing a more contributory and participatory creative environment.

Guest Post: IP LLM Guide

As LLM application deadlines approach, I thought it could be helpful for us to put out some guidelines or factors that applicants may want to consider while going through the tedious process of application and selection of universities – especially for those who are looking specifically at IP focused LLMs. (For those interested in a general LLM guide, Livelaw has put out a detailed 4 part series here). I asked Krithika D.N. if she could write us a guest post

Fire in the Blood – Reviewed

The narrative of IP is one that has been more or less hegemonized over the last 30 years. Simply stated, it is that “IP rights are good. Moreover, IP rights are necessary”. More controversially though, this narrative is “logically” extended to: “If IP is good, more IP must be better”. Despite the various nuances and details that IP regimes have displayed, this simplistic narrative still holds a powerful role in both public discourse as well as policy making. Several studies have
