This week on SpicyIP, our Highlight of the Week is Spadika’s post on a Brazillian team finally seeking permission to milk the benefits of the Ongole Bull, a species that is indigenous to Andhra Pradesh. She notes that while S. 3 of the Biological Diversity Act mandates that an approval from the National Biodiversity Authority (NBA) be taken before ‘foreigners’ obtain any biological resources, including animals and their by-products, or any knowledge associated with the same for research or commercial

The Times of India reports that a Brazilian team has made an application to the National Biodiversity Authority to obtain 5,000 units of the germplasm of the Ongole Bull, a species of cattle indigenous to Andhra Pradesh. This makes it naturally popular in AP, where it

SpicyIP Weekly Review (April 5 –12, 2015)

Although the 5th-12th of this month has been a bit of a slow week, we’ve had two rather interesting posts written by Mathews and Aparajita. Mathews had written on the need to consider non patent models for incentivizing drug discoveries, and discussed the various examples of newly emerging models that appear to present rather interesting opportunities. He first outlines the recently instituted Project Marilyn that launched a campaign to develop a crowd funded patent-free anti cancer drug – 9-deoxysibiromycin or 9DS. He then the

After 66A, Writ to Decriminalize Defamation before Supreme Court

In what seems like a great month for freedom of speech in India, Subramanian Swamy filed a Writ Petition before the Supreme Court asking the court to decriminalize defamation in India (here). This news was brought to us by Sai Vinod, a former blogger and an integral part of the SpicyIP team. After the Times Publishing House issued a defamation notice to me, threatening criminal action, I wrote a post on SpicyIP analyzing whether Sections 499/500 of the IPC

Spicy IP Weekly Review (March 29 – April 4, 2015)

We covered a wonderfully wide variety of concepts over this past week – a dual takedown of PPL and IPRS, Net Neutrality, Trade Secrets, Copyright in light of parodies, more comments on the Draft IPR Policy, Open Source Software, FRAND Litigation, a new centre for IP and Plagiarism. However, the highlight of the week goes to Rupali’s powerful two-part post analyzing Shreya Singhal. In the first part, she briefly discusses the findings in relation to Section 66A and 69A of

Policy innovation and improvisation on pharmaceutical drug discovery

As I sit down to pen this post, I am well aware of the complex, heavily debated policy dimensions on incentivizing innovations in the pharmaceutical industry. There is no one absolute ‘right’ answer to the various dilemmas posed by this discussion. In fact, there are several answers. Each one is right in its own way. As I see it, the only way out is to ‘try out’ which, of course, entails the ability to ‘embrace’ risks. As Paulo Coelho said,
