Justice Arjan Sikri Talk at NUJS: Injunctions vs Damages in IP Cases

Justice Arjan Sikri of the Delhi High Court is visiting NUJS over the coming weekend. As many of our readers may know, he is one of the most well regarded judges in India today and has authored some excellent decisions, particularly in the field of intellectual property law. In 2007, he was chosen as one of the 50 most influential persons in Intellectual Property globally in a survey conducted by Managing Intellectual Property (MIP).

He will speak this coming Saturday (7th Feb) at Room 006 (9.30 to 11.30 am) on “Injunctions vs Damages in IP Cases”.

His talk promises to be a very interesting one, particularly since this is a much debated area in IP law and Indian courts are currently grappling with complex issues such as:

i) When ought an injunction to be granted? And when ought damages to suffice?
ii) What ought to be the standards for the grant of an injunction (what exactly is a “prima facie” assessment etc)?
iii) what are the yardsticks for determining damages (compensatory/punitive/exemplary etc)?
iv) Will the non grant of an injunction tantamount to a compulsory license (as some argue in the aftermath of the eBay case in the US)?

If this topic excites you and if you are in Kolkata on that day, please feel free to attend. The talk will be in Room 006, Ambedkar Bhavan, NUJS and begins at 9.30 and is expected to finish (after Q/A with audience) at 11.30–but please feel free to enter and exit as you please.

As mentioned in an earlier email, the campus of NUJS is located in Salt Lake, Sector III, very close to the Beleghata bypass. Key landmarks are the National Institute of Fashion Technology [NIFT] and the College of Engineering and Leather Technology.

Please also feel free forward this to colleagues who may be interested in this event.
