B Braun is a leading Germany based global leader in medical devices. Poly Medicure is an Indian company that manufactures medical devices. B Braun has initiated patent infringement suits against Poly Medicure in several countries such as Germany, Italy, Spain, Australia and B. Braun Melsungen AG served the preliminary injunctions on the respective companies at their stand on the world’s leading medical trade fair MEDICA and where these companies attended as exhibitors in 2009. All infringing IV Catheters and promotional literature on the stands were seized by the court bailiff. Consequently, Polymed could not display its equipment at the most important trade fair in the world resulting in direct losses of participation and loss of business opportunity.
Five years later, Polymed won the infringement suits, both in Germany and India but the damage to business opportunity was already done. With simple precautions, Polymed could have avoided the pain and losses at Medica Trade Fair.
