Position: Head Legal – IP Affairs. Reports to the Global General Counsel/Deputy General Counsel. Responsible for providing legal support for Chief Technology Officer, R&D and Global IPR Management System. This is a specialized position requiring extensive knowledge and experience in domestic and international laws relating to Intellectual Property Rights, including Patents and Industrial Designs, Trademark and Service marks, Copyrights and Trade Secrets (IPR) and experience in filing and pursuing, defending IPR registrations and handling litigations.
Roles & Responsibilities: This includes-
(1) develop, implement and enforce the company’s Global IPR Management and Compliance Program to monitor areas of vulnerability and preventing potential infringement or misappropriation of IPR;
(2) monitor changes in IPR laws and provide IPR alerts on such changes and on major court decisions;
(3) legal advise and support in development, implementation and enforcement of IPR policies and manual of instructions and interpretation, including legal support CTO, R&D, BFS and other organizations of the Company and its subsidiaries on all legal matters relating to IPR;
(4) review of IPR forms/clauses in employment contracts, non-compete agreements and other contractual commitments;
(5) review and negotiation of Collaboration Agreements involving development and/or ownership of IPR, assignment of IPR or licensing of IPR (such as agreements with Universities, Research Projects, Alliance with Product Vendors etc) and support for business pursuits involving large deals with enterprise license for developing bundled solutions (such as SAP, Oracle, EMC etc); and
(6) managing disputes and litigations related to IPR, including engagement of outside counsel and managing outside counsel relationship.
Required Qualification:
(a) Minimum: Bachelor’s degree in Law necessary to practice law. Additional (desirable) qualifications: degree or diploma in any outside jurisdiction (UK, USA, APAC or Europe).
(b) Admission to bar (license to practice law) in India. It would be an advantage if admitted in other major jurisdictions.
(c) Minimum of 15 years of legal experience with at least 7 years in practice or environment focusing on IPR.
Salary: Completely depends on the calibre/experience of the professional – and not a constraint.
