Spicy IP Tid-bit: Ministry of Commerce & Industry invites suggestions on Draft IPAB Rules

The Ministry of Commerce and Industry has some time back come up with a new notification regarding having completed a preliminary draft of the Patents (Appeals and Applications to the Intellectual Property Appellate Board) Rules, 2010. The notification (DIPP Notification No. GSR690(E), dated August 18, 2010) is aimed to inform all the stakeholders involved and all members of the public that the said draft shall be considered after 45 days have elapsed since the date of Gazette notification. In course of that period suggestions and objections, if any, are being invited from the public. The draft rules are meant to address, inter alia, procedural provisions regarding appeals, applications, condonation of delay in filing appeal and fees etc. Any aforementioned suggestion/objection has to be sent to the Secretary, Ministry of Commerce and Industry, Department of Industrial Policy and Promotion (1PR 1 Section) Udyog Bhawan, New Delhi -110011 before expiry of the said period.

  1. For an ordinary person, this (the draft) is a lot of technical mumbo-jumbo.

    Would appreciate an article on how this would matter to ordinary people.
