SpicyIP Tidbits: Satyam loses appeal against Upaid: update

Some of you might remember the Satyam vs Upaid case that SpicyIP had reported on some months ago. There is an update to that, which I thought was worth running here, even though it is only distantly related to IP issues. Satyam went to the Court of Appeal in London in that case, which it lost this week with the ruling affirming the original January judgement, and directing Satyam to pay costs. This also means that the original litigation in

The story of the bribe-taker in the Trademark office

How often have you heard stories of hundred-rupee notes surreptitiously slipped into the inside flap of the folder slid across the table to that greasy-palmed government official in that dank office? And you have, no doubt, wondered if you will ever live to see the system change… For those of you who read the city pages of your daily newspaper carefully enough, will recall those three-centimeter, one column, stories of our investigative agency’s hunts, of many a guilty sarkari serpent,

Mango season has begun, and I suppose it’s appropriate that the Mazaa trademark (one of the few packaged mango drinks on the market) should be fought over at this time of year. Two separate articles, in Economic Times and Business Standard, report that Bisleri, the biggest packaged-water player in India, is planning legal action against Coca-Cola (CC) India for attempting to register the Mazaa trademark in other parts of the world. The story so far:Bisleri claims CC had applied to

Moser Baer in Tamil film titles tussle

So we’re back to a pet SpicyIP subject (beyond the pharma buzz): home entertainment and the Moser Baer (MB) phenomenon. This time around, the optical disc manufacturer-turned-home video giant is in a tussle over alleged copyright infringement of its newly-expanded Tamil film titles’ list. Although the question right now is preliminary and primarily jurisdictional, it will be interesting to see whether similar issues get raised by rights-claimants in other non-Mumbai film industries. What I gather from the latest HT report

Indian withdrawal from intl power project over tech transfer issues

This is a slightly delayed note on a tech transfer dispute that is brewing on the power (sic) front in $2 billion, or Rs 8,000 crore, Indo-US FutureGen project. Mint had reported about a week ago

SpicyIP Tidbits: Chrysler-Mahindra in Jeep-fight

Auto major Chrysler’s South African arm has complained against a local ad run by Mahindra & Mahindra, which uses its automobile marquee “jeep”, saying it owns the trademark to the world’s oldest sport utility vehicle of World War II vintage. An agency report on Sify says that “The Advertising Standards Authority of South Africa (Asasa) is looking at the matter even as Mahindra and Mahindra says it used “jeep” with a lower case to denote the generic name for the

An Indo-US film industry study has been doing some number crunching for piracy in India, of which Mint here gives us a sneak preview.
