Rajiv Kr. Choudhry
Rajiv did his engineering from Nagpur University in 2000 in electronics design technology. He has completed his LL.B. from Delhi University, Law Center II in 2006, while working as an engineer at ST Microelectronics in NOIDA. After his LL.B., he went on to The George Washington Univeristy, Washington DC to do his LL.M. in 2007. After his LL.M., he has worked in the US at a prestigious IP law firm based out of Philadelphia. Till 2014, he was Of-Counsel to a Noida based IP law firm where he specialized in advising clients on wireless, telecommunication, and high technology. Rajiv is the founder of Tech Law Associates, a New Delhi based law firm specializing in IP law, with a focus on high - technology, and patent law. His core IP interest areas are the intersection of technology and IP, Indian IP policy, innovation, and telecommunications patents. He is also an inventor with pending applications in machine-to-machine communications domain (WO2015029061).

Paper I has some very ambiguous questions. e.g
Q 14 Would the term ‘anyone’ include the applicant also? If yes, then option (c) is correct, if no then only (a) wouldbe correct?
Also, how would you construe the instruct regarding the partial correct answer.
Eg:
If option (e) all of the above is correct & someone is confident of marking options (a) & (b) alone, both ofcourse partially correct. Then would they get partial marks as per the instructions.
Well Exam was Good but then there were problems in the Interview. IPO had assigned the boards on so called random basis whereas in actually they were Pre- decided.
Moreover comming to the point that the panel was asking the questions not related to the Patents but to the Whole IPR. Members were adamant on some points and did’nt agreed on whatever the recent Judgements were cited to them. For Ex. i commented on Novartis case where 3 of the 2 member’s of the panel said No Supreme Court of india is wrong and you are wrong also. Howcan someone react to the one’s view on the Judgment and make other’s view & point be wrong.
I fail to understand how the IPO wants to work in when one patent can be & Can’t be rejected on various issues.
They were expecting Experienced Persons in the Patent Agent exam and one of the member asked me why did’nt i took coaching for the patent agent exam and why i was not working with a patent law firm.
It is my choice where i want to work in and where not and i fail to understand how does it make any impact on my patent knowledge and if they want experienced person then why there is provision for debarring the person & making him laible to pay fine if he is not patent agent.
